Terms and Conditions

1. All payments are to be made according to the category/size of the property, as per schedule of the payments in favour of “Golden Estate (SMC-Pvt.) Ltd.” at designated Golden Estate (SMC-Pvt.) Ltd. offices/branches or bank branches. Golden Estate (SMC-Pvt.) Ltd. offices will accept cash/cheque and bank draft/pay order.
2. Installments received after the due date from the allottees/applicants will only be accepted with surcharge @ 1.5% per month, which will be taken as @ 0.05% daily. Provided that if any allottee fails to pay 2 successive installments within the prescribed period, the allotment is liable to be cancelled. In the event of cancellation of the plot by Golden Estate (SMC-Pvt.) Ltd., the submitted payment will be refunded with 25% deduction, without any profit, interest or markup; however, the membership fee already paid is non-refundable.
3. No applicant shall be entitled to claim or receive any interest/markup against the amounts paid by him to Golden Estate (SMC-Pvt.) Ltd.
4. One Booking Form can be used for seeking allotment of one residential plot only.
5. A plot allotted to an applicant shall not be used by the allottee for any purpose other than that applied/allotted.
6. Only the pre-approved elevation by TMA/Golden Estate (SMC-Pvt.) Ltd. for a given plot can be constructed on the plots. No further construction or modification to any construction can be done without the prior approval of TMA/Golden Estate (SMC-Pvt.) Ltd.
7. In case of extra area, amount will be charged in addition to the total amount; likewise, in case of lesser area, proportionate amount will be adjusted accordingly.
8. Notwithstanding the balloting, the exact size and location of the plot will remain tentative and subject to adjustment in accordance with demarcation/measurement of the plot at time of handing over of possession.
9. All registration/mutation charges shall be borne by the allottee along with any other government tax in vogue.
10. Golden Estate (SMC-Pvt.) Ltd. reserves the right to allot/sell a plot cancelled from the name of the allottee due to nonpayment of dues, or any reason whatsoever, to any other applicant or person and the ex-allottee shall have no right to such a plot. Golden Estate’s decision in this regard shall be final. Any disputes shall be resolved in accordance with para 11 below.
11. In case of any dispute between the allottee and Golden Estate (SMC-Pvt.) Ltd., the dispute will be referred to arbitration by an authorized officer of Golden Estate (SMC-Pvt.) Ltd. whose decision shall be final and binding on the parties to the dispute.
12. Every applicant will abide by these Terms and Conditions in addition to the bye laws, rules and regulations governing allotment, possession, ownership, construction and transfer of plots, enforced from time to time by Golden Estate (SMC-Pvt.) Ltd. and any other Authority/Department competent to do so, in accordance with applicable laws.
13. Additional cost of 10% would be payable in case of corner plot.
14. Sale, Mortgage, Gift or Transfer of the plot is admissible only with the specific approval of Golden Estate (SMC-Pvt.) Ltd. and on completion of all laid down procedural formalities as per rules of Golden Estate (SMC-Pvt.) Ltd. Transfer of plot allotted to an applicant shall be allowed only after receipt of updated payment/charges. All registration/mutation charges shall be borne by the allottee.
15. Golden Estate (SMC-Pvt.) Ltd. reserves its right to accept or reject any or all requests so received without assigning any reason or change its number or size due to unforeseen reasons in the interest of Golden Estate (SMC-Pvt.) Ltd. and its Members.
16. Golden Estate (SMC-Pvt.) Ltd. further reserves its right to cancel the membership or allotment of the plot in case the Member is found working against the interests of Golden Estate (SMC-Pvt.) Ltd.

Declaration

I have read all the rules and regulations accompanying this form and I hereby agree to abide by those as well as all existing and future Golden Estate (SMC-Pvt.) Ltd. rules.
